Lichfield shop told to pay £5,000 over noisy refrigeration units

A Lichfield shop has been told to pay £5,000 because of noisy refrigeration units.

Dave’s Discount (Stores) Ltd pleaded guilty to failing to comply with an abatement notice at Stafford Magistrates’ Court.

Following a complaint about the noise made by two refrigeration units at The Local store on Wheel Lane, Lichfield District Council issued the notice in June 2013. But the noise continued after the cut-off date in September 2013.

As a result, court proceedings were launched and Dave’s Discount (Stores) Ltd was fined £4,000 and ordered to pay a victim surcharge of £120. The council was awarded costs of £1,080.

Councillor Colin Greatorex, Lichfield District Council’s Cabinet Member for Community, Housing & Health, said: “Having visited the area, and heard the noise the refrigeration units made, our environmental protection officers decided it was unreasonable and was causing a nuisance.

“When no effort was made to remedy the situation, we started court proceedings.

“This positive outcome shows just how important it is for businesses to be good neighbours.”
