A builder has been fined after Lichfield District Council caught him illegally carrying and dumping waste in the area.

Lesley Birch, of Salters Road in Walsall, was due to appear at Tamworth Magistrates’ Court on March 10, but did not attend. In his absence the court found him guilty of failing to demonstrate his waste duty of care and of not carrying a waste carrier’s license.

The court ordered Mr Birch to pay £1,000 for failing to demonstrate his waste duty of care, £500 for not carrying a waste carrier’s licence, and a further £533 court costs.

The case was revealed on the same day the Council released details of a new crackdown on fly-tippers.

According to the law, builders, tradesmen and other waste producing businesses must have a waste carrier’s license to transport waste. They should also keep documentation showing they are disposing of all their waste at a licensed tip.

Mr Birch was caught after an environmental health officer spotted him transporting and dumping waste at an unregistered tip when they were carrying out covert surveillance last year. Because Mr Birch then failed to prove he had the correct documentation and a waste carrier’s licence and refused to pay two fixed penalty notices, the council started court proceedings against him.
